1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Postrivo ("we," "us," or "our"), a social media marketing platform that helps individuals and teams plan, publish, and analyze content across social media platforms. By creating an account or using the platform, you agree to be bound by these Terms. If you do not agree, do not use Postrivo.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use Postrivo. By using the platform, you represent that you meet these requirements and that any information you provide during registration is accurate and complete.

3. Your Account

• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account
• You must notify us promptly of any unauthorized use of your account
• You are responsible for the accuracy of the information you provide, including organization and team member details
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Connected Social Media Accounts

Postrivo allows you to connect third-party social media accounts (such as Facebook, Instagram, LinkedIn, and TikTok) in order to publish content and retrieve analytics on your behalf. By connecting an account, you:

• Authorize Postrivo to access, publish to, and retrieve data from that account using the permissions you grant
• Confirm that you have the right to manage and post content to the connected account
• Remain responsible for complying with each platform's own terms of service and content policies
• May disconnect any connected account at any time through Settings > Connections

We are not responsible for changes, outages, or policy decisions made by third-party platforms that affect your connected accounts.

5. Acceptable Use

You agree not to use Postrivo to:

• Post or schedule content that is unlawful, defamatory, fraudulent, or infringes on the rights of others
• Violate the terms of service or content policies of any connected social media platform
• Distribute malware, spam, or unsolicited bulk content
• Attempt to gain unauthorized access to the platform, other accounts, or our infrastructure
• Reverse engineer, decompile, or interfere with the normal operation of the platform
• Use the platform in any way that could disable, overburden, or impair our services

6. Content Ownership

You retain ownership of all content, media, and captions you create or upload through Postrivo ("Your Content"). By using the platform, you grant us a limited license to store, process, and transmit Your Content solely for the purpose of providing the service, including publishing to your connected social media accounts and generating analytics. We do not claim ownership of Your Content and do not use it to train AI models.

7. AI-Assisted Features

Postrivo offers AI-assisted features such as caption generation, rewrites, hashtag suggestions, and content ideas. These features rely on third-party AI providers and are intended as drafting aids. You are responsible for reviewing and approving any AI-generated content before it is published. We do not guarantee the accuracy, originality, or suitability of AI-generated suggestions.

8. Subscriptions and Billing

• Paid plans are billed in advance on a recurring basis until cancelled
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• Fees are non-refundable except as required by law or expressly stated at the time of purchase
• We may change our pricing with advance notice; continued use after a price change constitutes acceptance of the new pricing

9. Service Availability

We aim to keep Postrivo available and reliable, but we do not guarantee uninterrupted access. The platform depends on third-party infrastructure and social media platform APIs, which may experience outages or changes outside our control. We are not liable for any failure to publish, schedule, or retrieve data caused by a third-party service disruption.

10. Termination

You may deactivate your account at any time through Settings > Profile > Deactivate Account, which permanently deletes your posts, media, connections, team data, and settings. We may suspend or terminate your access to Postrivo if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law.

11. Disclaimers

Postrivo is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be error-free, secure, or available at all times.

12. Limitation of Liability

To the fullest extent permitted by law, Postrivo and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the platform, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Postrivo operates, without regard to conflict-of-law principles, unless otherwise required by applicable local law.
